Functional Title:  Medicaid Section Chief

The Medicaid Section Chief supervises attorneys and agency administrative review officers in Medicaid administrative hearings and other administrative hearings. The Section Chief is responsible for conducting Medicaid hearings and issuing Medicaid orders. The position is also responsible for developing training materials for administrative hearings staff, performing quality reviews for administrative law judges and administrative review officers, performing legal research and drafting proposed legislation, monitoring and reviewing program operations to ensure program compliance with state and federal laws and regulations, and developing policies and procedures to improve unit processes and procedures. The Medicaid Section Chief may also have to conduct internal employee grievance hearings and make recommendations to the Secretary.

Summary

The Managing Attorney is responsible for conducting legal research and writing legal documents for use in litigation, providing legal assistance to the agency, and supervising subordinate attorneys and legal administrative support staff. This position is governed by state and federal laws and agency/institution policy.

Functions

Supervises and manages support staff and subordinate attorneys by interviewing, hiring, providing training, assigning workloads, and evaluating performance of incumbents. Provides legal services and advice to management and divisions on a broad range of matters. Represents the agency in negotiations. Represents the agency in litigation including all administrative and court proceedings. Interprets and analyzes all state and federal laws. Drafts new or revised policy and legislation. Conducts legal research. Drafts and prepares legal briefings and pleadings and responds to subpoenas. May develop and prepare budgets. Performs other duties as assigned.

Minimum Qualifications

Licensed to practice law and admitted to the Arkansas State Bar. ACA 16-22-201. The formal education equivalent of a law degree from an accredited law school; plus six years of experience in law, including three years in a supervisory capacity. Additional requirements determined by the agency for recruiting purposes require review and approval by the Office of Personnel Management. OTHER JOB RELATED EDUCATION AND/OR EXPERIENCE MAY BE SUBSTITUTED FOR ALL OR PART OF THESE BASIC REQUIREMENTS, EXCEPT FOR CERTIFICATION OR LICENSURE REQUIREMENTS, UPON APPROVAL OF THE QUALIFICATIONS REVIEW COMMITTEE.
