This position serves as the General Counsel for the Arkansas Department of Parks, Heritage and Tourism and is responsible for providing professional legal counsel and administering legal services for the department. Position is the department’s legal resource in the day-to-day activities and interactions that occur in the business of the department, advises executive leadership, division directors, and management on a broad range of legal issues affecting the department and offers legal opinions on actions that may be taken in resolving legal issues. The General Counsel will also review contracts and other legal documents and will represent the department in legal contracts and negotiations. Position represents the department in legal proceedings which may occur in state or federal courts, reviews, recommends, and drafts proposed legislation, amendments to current legislation, amendments to department regulations, and represents the department at legislative hearings. Prepares records and responses to requesting parties seeking documents and records under the Freedom of Information Act (FOI). Prepares and files answers to Writs of Garnishment and performs other duties as assigned.
Must have knowledge of state and federal laws, litigation practices and procedures, and the state’s legislative processes. Must have the ability to research, analyze, interpret, and apply case law, state and federal statutes, legal precedents, and relevant legislative intent to department legal matters. Must be able to communicate across all levels of the agency, provide legal guidance and technical assistance to department management, and establish and maintain cooperative working relationships with department staff and other relevant legal and department contacts.
Minimum Qualifications: The formal education equivalent of a law degree from an accredited law school; eight plus years of experience in public sector law including 2 years of litigation experience.
Required Certificates: Licensed to practice law and admitted to the Arkansas State Bar per ACA 16-22-201.
