Summary

The Department Administrative Law Judge is responsible for conducting administrative hearings and adjudicating cases involving issues arising under either state laws, or rules and regulations of state agencies. The Department Administrative Law Judge performs advanced administrative hearing work in a specialized area of law by presiding over contested cases, hearings, and alternative dispute resolution proceedings. This position is governed by state and federal laws and agency/institution policy.

Functions

Conducts administrative hearings and adjudicates cases involving issues arising under either state laws, or rules and regulations of state agencies. Researches case law, state statutes and any applicable federal laws related to current legal issues in order to prepare for potential mediation, litigation, conciliation agreement, or settlement. Analyzes, researches, and interprets state laws and agency rules and regulations to determine what precedential decisions may already exist relevant to the facts in the case. Grants or denies postponements and continuances, determines admissibility of evidence, rules on discovery disputes, administers oaths and examines witnesses, and applies relevant rules and statutes in the administrative hearing. Reviews all information presented in the hearing and post-hearing briefs and issues official opinions or decisions by summarizing the facts of the case, applicable laws, rules or regulations, reason for decision, and decision reached. Performs other duties as assigned.

Dimensions

Occasional to frequent in-state travel to attend fact finding meetings, hearings, and/or court proceedings is required. Occasional out-of state travel related to agency legal matters may be required.

Knowledge, Skills and Abilities

Knowledge of state laws and applicable agency rules and regulations. Knowledge of the rules of evidence and administrative hearing procedures. Knowledge of administrative processes and state government operations. Knowledge of the substantive rights and obligations of parties subject to agency rules and regulations. Ability to research, analyze, interpret, and apply case law, state law, agency rules and regulations, legal precedents, and relevant legislative intent to agency legal matters. Ability to research and analyze complex issues, weigh evidence, and reach conclusion supported by the facts and the law. Ability to write findings of fact, conclusions of law, and orders.

Minimum Qualifications

The formal education equivalent of a law degree from an accredited law school; plus five years of experience in administrative law conducting administrative hearings. Additional requirements determined by the agency for recruiting purposes require review and approval by the Office of Personnel Management.
