Assistant Attorney General

Position Overview

Join the Special Litigation Section (SLS) of the Office of the Arkansas Attorney General (OAG) and engage in some of the most challenging and significant civil litigation in the state. This position focuses on protecting and upholding Arkansas laws and the Constitution. Recent high-profile cases managed by SLS include defending school choice through the LEARNS Act—considered to be among the most significant conservative education reforms in the country; upholding social media legislation that protects minors from harmful content; preserving election integrity; protecting the public from dangerous drugs like Delta-8; and strengthening the criminal justice system by defending laws that are ending the state’s longstanding catch-and-release approach to criminal prosecution. Specific issues litigated include Constitutional challenges involving Equal Protection, Due Process, preemption, freedom of speech, and the opportunity to litigate matters of first impression.

As a member of SLS, you will:

  • Experience a dynamic, fast-paced work environment;

  • Provide legal representation and advice to Arkansas officials, agencies, departments, boards, and commissions; and
  • Engage in high-level decision and strategy sessions to tackle urgent and complex legal issues.

Minimum Requirements

  • Law degree from an accredited law school.
  • License to practice law in Arkansas or the ability to quickly obtain an Arkansas license.

 

Preferred Qualifications

  • Five or more years of litigation experience.
  • Judicial clerkship.

Summary

Incumbent serves as an Assistant Attorney General within the Special Litigations Section of the Civil Division.

Functions

Legal work performed is characterized as routine where factual questions are involved with clear applicable precedents.

 

Incumbent is responsible to handle routine factual or policy issues that involve research, analysis, and obtaining expert testimony or information in areas of scientific, financial, corporate, medical, engineering, or other technical areas.

Conducting legal research.

Analyzing the factual and legal issues.  Reviews policies, procedures, regulations, technical manuals, and other agency publications.  Study industry and trade practices.  Conducts research of laws, legal opinions, policies, regulations, legal texts, and precedent cases bearing on the legal issues involved in the problem, proposal, or case.  Conducts pretrial examination of witnesses.  Preparing memoranda or reports outlining the facts and legal issues, analyzing the factual and legal issues involved, explaining the application of legal principles and precedents, and justifying recommendations or conclusions.

Responsible for litigating on behalf of the State’s interests in Arkansas State Circuit Courts, Arkansas State Claims Commission and Federal District Courts, as well as briefing appeals to the Arkansas Supreme Court and Court of Appeals and the Eighth Circuit Court of Appeals.

Knowledge, Skills and Abilities

Ability to complete work accurately with respect to legal citations, treatment of facts, and other aspects of technical treatment.  Ability to produce written work that demonstrates soundness of approach and argument, application of legal principles, and that is consistent with the governing policies, procedures, and regulations of the employing agency.

Minimum Qualifications

Minimum of a high school diploma or equivalency and graduation from an accredited four-year college or university and Juris Doctorate.  Licensed to practice law in the State of Arkansas or able to quickly obtain a license to practice law in the State of Arkansas

Prefer at least 5 years of litigation experience. Prefer a Judicial clerkship experience.
