Position Summary
The Division of Workforce Services (DWS) Program Operations Manager will function as the State Monitor Advocate for the Migrant and Seasonal Farmworker (MSFW) Program and is responsible for ensuring compliance with federal program regulations. This position is governed by state and federal laws and agency policy
Education and Professional Work Experience
Minimum Qualifications
The formal education equivalent of a bachelor's degree in general business, public administration, or a related field; plus, three years’ experience in personnel management, program administration, human services, public administration, or a related field.
Federal U.S. Department of Labor Minimum Qualifications
In accordance with the Workforce Innovation and Opportunity Act of 2014 (WIOA) Regulations at §653.108, the preferred candidate must be:
- From a Migrant and Seasonal Farmworker (MSFW) background; or
- Speak Spanish or other languages of a significant proportion of the State MSFW population; or
- Who have substantial work experience in farmworker activities.
Knowledge, Skills, and Abilities
- Knowledge of supervisory practices and procedures.
- Knowledge of state budget procedures.
- Knowledge of specialized DWS program area practices and procedures.
- Knowledge of state and federal laws regulating specialized DWS program areas.
- Ability to plan, organize, and oversee the work of subordinates.
- Ability to evaluate program effectiveness and modify as necessary.
- Ability to interpret and apply federal and state laws and regulations.
- Ability to prepare and present oral and written information and reports.
- Ability to review written reports, recommend corrective action, and oversee compliance investigations
Job Responsibilities and Expected Results
In accordance with the Workforce Innovation and Opportunity Act of 2014 (WIOA) Regulations at §653.108, the State Monitor Advocate must:
- Conduct an ongoing review of the delivery of services and protections afforded by the ES regulations to MSFWs by the SWA and ES offices (including efforts to provide ES staff in accordance with § 653.111, and the appropriateness of informal complaint and apparent violation resolutions as documented in the complaint logs). The SMA, without delay, must advise the SWA and local offices of problems, deficiencies, or improper practices in the delivery of services and protections afforded by these regulations and may request a corrective action plan to address these deficiencies. The SMA must advise the SWA on means to improve the delivery of services.
- Participate in on-site reviews on a regular basis, using the following procedures:
- Before beginning an onsite review, the SMA or review staff must study:
- Program performance data.
- Reports of previous reviews.
- Corrective action plans developed as a result of previous reviews.
- Complaint logs including logs documenting the informal resolution of complaints and apparent violations; and
- Complaints elevated from the office or concerning the office.
- Before beginning an onsite review, the SMA or review staff must study:
- Review and approve the SWA's Agricultural Outreach Plan (AOP).
- On a random basis, review outreach workers' daily logs and other reports including those showing or reflecting the workers' activities.
- Write and submit annual summaries to the State Administrator with a copy to the Regional Administrator as described in this section.
- Perform other duties as assigned.
